AN ORDINANCE OF THE CITY OF GLENWOOD SPRINGS, COLORADO, AMENDING SECTIONS 100.010.090 AND 100.010.100 OF THE GLENWOOD SPRINGS FOR ANIMAL AND WILDLIFE PROTECTION REGARDING TO SOLID WASTE COLLECTION
the City of Glenwood Springs (“Glenwood Springs” or the “City”) is a home-rule municipality organized under Article XX of the Colorado Constitution and with the authority of the Glenwood Springs Home Rule Charter; and
Ordinance 05, Series of 2023 amended Article 100.010 regarding solid waste collection in the City; and
Section 100.010.090 of the Glenwood Springs Municipal Code regulates animal and wildlife protection in the City and refers to a penalty schedule for violations; and
City Staff are recommending an update to the penalty schedule and correcting the reference to the penalty schedule in Section 100.010.090; and Section 100.010.100 of the Glenwood Springs Municipal Code addresses violations of the provisions of Article 100.010; and
City Staff are recommending a correction to the reference for punishments for violations of Article 100.010; and
City Staff has recommended updating Sections 100.010.090 and 100.010.100 as set forth on Exhibit A attached hereto; and
the City Council finds and declares that it is necessary for the preservation of health and safety of the City and its residents to amend the Sections 100.010.090 and 100.010.100.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF GLENWOOD SPRINGS, COLORADO, ORDAINS:
Section 1. The foregoing recitals are incorporated herein as if set forth in full.
Section 2. Sections 100.010.090 and 100.010.100 of the Glenwood Springs Municipal Code is amended as set forth in Exhibit A attached hereto.
Section 3. The amendments to Sections 100.010.090 and 100.010.100 shall become effective on June 1, 2024.

100.010.090 Animal and wildlife protection.
(a) It shall be unlawful for any person, place of business, or occupant of premises within the City to store garbage, refuse or trash, including recyclables, that is attractive to or edible by animals or wildlife.
(b) It shall be unlawful for the owner, occupant or any person with responsibility for maintenance of any property located within the City, including properties used for special events and properties that are the site of construction activities, to permit the accumulation on the property of garbage, refuse or trash attractive to or edible by animals or wildlife. Solid waste shall be stored on and collected from such properties in accordance with the provisions of this article.
(c) It shall be unlawful for any person to knowingly leave or store any solid waste, recyclable, food product, pet food, grain, salt or any other materials attractive to or edible by animals or wildlife in a manner which may attract or entice animals or wildlife.
(d) Bird feeders shall be permitted under this section. However, between the dates of April 15 and November 15, all feeders must be suspended on a cable or other device so that they are inaccessible to animals and wildlife, other than birds, and the area below the feeders must be kept free of the accumulation of seed,
seed debris, or other attractive or edible materials.
(e) Penalty schedule for Section 100.010.065 violations. The penalties outlined below may be reduced or suspended upon the violator providing proof of purchase of a Wildlife Resistant Refuse Container on or before the violator’s appearance in Municipal Court on such offense.
(f) Persons, places of business or occupants of premises may place non-wildlife-resistant solid waste containers containing any trash or organics material at the curb, near the alley abutting the premises, or if there is no alley, in some accessible place where it can be removed by the collector between the hours of 6:00 a.m. and 7:00 p.m. on their designated collection day only. These containers shall be removed to a secure location such as inside the house, garage, enclosure or other area approved by the City during all other times. It is recommended that recyclable material containerization be managed in the same manner.
(g) If animals or wildlife gain access to non-wildlife-resistant containers two (2) or more times during any twelve-month period, the City may require wildlife-resistant containers for all subsequent collections.
100.010.100 Violations.
(a) Violations of Section 090 above shall be subject to the following fine schedule.
(1) First Offense: Fifty Dollar ($50.00) fine to the owner, occupant or any person with responsibility for maintenance of such property.
(2) Second Offense: Five Hundred Dollar ($500.00) fine to the owner, occupant or any person with responsibility for maintenance of such property.
(3) Subsequent Offenses: The Municipal Court may impose such fines and penalties as it is authorized pursuant to Municipal Code Section 010.020.080.
(b) In addition to any other remedies provided by this article, any person violating any of the provisions of this article shall be deemed guilty of a misdemeanor and, upon conviction of the same, shall be punished in accordance with the provisions of Section 010.020.080.
